TERMS OF SERVICE

About these terms

These terms apply to all work A91 Design does for you: websites, online stores, branding, digital marketing, social media, systems, technical support, hosting and management. A91 Design is run as a sole trader, based in East Grinstead, West Sussex.

By accepting a quote or paying a deposit, you agree to these terms. If anything in your quote differs from these terms, the quote wins.

Quotes

Quotes are based on the work we have agreed with you and are valid for 30 days. If you ask for something outside that, we will tell you the cost before we start it.

Payment

• A £150 deposit books your project in and starts the work.
• The balance for a website or online store is due at launch.
• Invoices are due within 14 days.
• Hourly work, such as design or technical support, is invoiced once it is done.
• Advertising spend is paid by you, directly to Google or Meta, on top of our fees.

If an invoice is overdue, we may pause work, or management of your site, until it is paid. For business clients, we may also charge interest under the Late Payment of Commercial Debts (Interest) Act 1998.

Your part

• Send us the content, images and logins we need, when we need them.
• Only send us material you have the right to use. You are responsible for it.
• Check designs and give feedback within a reasonable time.

If a project is on hold for more than 60 days waiting on you, we may invoice for the work done so far.

Designs and changes

You see the designs before anything is built, and each stage includes reasonable rounds of changes. Larger changes once a stage is signed off, or new features, are quoted separately.

Ownership

Once you have paid in full, the website, designs and content we made for you are yours.

• Third party items, such as plugins, fonts, stock images and platforms like Shopify, stay under their own licences.
• Our own tools, code libraries and know-how stay ours. You get a licence to use them as part of your site.
• We may show the work in our portfolio. Just tell us if you would rather we did not.

Your domain name is yours. If you leave, we will transfer it to you or your new provider.

Hosting and management

Managed plans run for a year at a time. Year one is included in your managed package, and from year two the plan renews each year unless you tell us at least 30 days before the renewal date.

Management covers what is listed on our website: updates, security, backups, monitoring, and the extras you have chosen. We work hard to keep your site online but cannot promise it will never go down, for example if a supplier has an outage.

Leaving us

You can move your site at any time. We will give you a copy of your site files and data and help with the move. Fees already paid for the current year are not refunded.

Results

We use our skill and experience to help your business be found and win work, but nobody can guarantee search rankings, AI answers, advert results or visitor numbers, and we do not.

Technical support

Most support is done remotely. Please keep your own backup of important files before we work on a device. We are not responsible for data lost because of a fault that was already there.

Your customers’ information

When we host or manage your site, we handle your visitors’ and customers’ information only on your instructions. We keep it secure and confidential, only use trusted providers to store it, help you if someone asks about their information, tell you without delay if something goes wrong, and return or delete it when we stop working together. Our privacy policy explains how we handle our own information.

Ending a project

Either of us can end a project by telling the other in writing. You pay for the work done up to that point, and the deposit covers the work at the start.

If you are a consumer rather than a business, you have 14 days to cancel after agreeing to work with us. If you ask us to start within those 14 days, you pay for the work done before you cancel.

Our liability

Nothing in these terms limits our liability for death or injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Otherwise, our total liability to you is limited to the amount you have paid us in the 12 months before the claim. We are not liable for lost profits, lost business or other indirect losses. If you are a consumer, your legal rights are not affected.

Changes and law

We may update these terms from time to time. The terms that apply are the ones in place when you accepted your quote. These terms are governed by the law of England and Wales.
